Terms of service.

This is an informative translation. In the event of any discrepancy, the Polish version of this document prevails.

Terms for the provision of services by electronic means, as referred to in Article 8 of the Polish Act of 18 July 2002 on the provision of services by electronic means. They set out the rules for using apexs.pl and its contact form. They are made available free of charge and in a form that can be downloaded, saved and printed.

§ 1. General provisions

  1. The Service Provider is APEX SUPPORT Spółka z ograniczoną odpowiedzialnością, with its registered office in Wrocław, Poland, ul. Stanisławowska 47, 54-611 Wrocław, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for Wrocław-Fabryczna in Wrocław, VI Commercial Division of the National Court Register, under KRS no. 0001026908, VAT ID (NIP) 894 320 78 65, REGON 524815558, share capital 5 000,00 zł.
  2. Contact: biuro@apexs.pl or in writing at the registered office address.
  3. These Terms apply to everyone using the Website.
  4. Use of the Website is free of charge.

§ 2. Definitions

  • Website - the website available at https://apexs.pl together with all its subpages.
  • Service Provider - the entity identified in § 1(1).
  • User - any natural person, legal person or organisational unit using the Website.
  • Form - the interactive contact form available on the Website, used to send an enquiry.
  • Service - a service provided by electronic means within the meaning of the Act referred to above.

§ 3. Type and scope of services

  1. The Service Provider provides the following services on the Website:
    • provision of informational content - free access to information about the Service Provider's activities, services and completed projects, provided at the User's request, on a one-off basis, for the duration of the visit;
    • contact form - the ability to send an enquiry by electronic means, provided on a one-off basis, for the time taken to complete and submit the Form.
  2. The Website is informational in nature. Its content, including descriptions of services, project parameters and figures, does not constitute an offer within the meaning of Article 66 § 1 of the Polish Civil Code, but an invitation to conclude a contract within the meaning of Article 71 of that Code.
  3. Submitting the Form does not oblige either party to enter into a contract for works or to begin negotiations.

§ 4. Technical requirements

Proper use of the Website requires:

  • a device with internet access;
  • a current web browser (Chrome, Firefox, Safari, Edge or equivalent) supporting HTML5 and CSS3;
  • JavaScript enabled - the Website also works without it, but some conveniences (animations, submitting the Form without a page reload) will be unavailable;
  • an active e-mail address - if the Form is used.

The Service Provider notes that using services provided by electronic means involves risks typical of the internet, in particular malicious software and unauthorised access to transmissions. Use of up-to-date security software is recommended.

§ 5. Rules of use

  1. The User is prohibited from supplying unlawful content, in particular content infringing third-party rights, offensive or misleading content, or content containing malicious software.
  2. Using the Form to send unsolicited commercial information is prohibited.
  3. Actions disrupting the operation of the Website are prohibited, including attempts at unauthorised access, automated content retrieval that burdens the infrastructure, and circumvention of the Form's safeguards.
  4. In the event of a breach of the above, the Service Provider may block access to the Website or the Form.

§ 6. Conclusion and termination of the agreement

  1. The agreement for the provision of informational content is concluded when the User enters the Website and terminates when the User leaves it.
  2. The agreement for the Form service is concluded when the User begins completing it and terminates upon submission of the enquiry or upon earlier abandonment.
  3. The User may cease using the services at any time by leaving the Website, at no cost.

§ 7. Complaints

  1. Complaints regarding the operation of the Website may be submitted to biuro@apexs.pl or in writing to the Service Provider's registered office.
  2. A complaint should describe the problem, the date it occurred and the contact details of the person submitting it, so that a prompt reply can be given.
  3. The Service Provider examines the complaint and replies within 14 days of receipt, to the address from which the complaint was sent.
  4. Failure to reply within that period means the complaint is deemed accepted, provided the person submitting it is a consumer.

§ 8. Copyright

  1. The Website and its elements - in particular texts, layout, trade marks, photographs, technical drawings and source code - are legally protected and are the property of the Service Provider or are used under appropriate rights.
  2. The names and trade marks of manufacturers referred to on the Website belong to their respective owners and are used solely to indicate the systems the Service Provider works with.
  3. Copying, reproducing or distributing the content of the Website in whole or in part, for purposes other than permitted personal use, requires the prior written consentof the Service Provider.

§ 9. Personal data

The rules for processing personal data, including the information required by Article 13 GDPR, are set out in a separate document: Privacy Policy.

§ 10. Liability

  1. The Service Provider makes every effort to keep the Website continuously available but reserves the right to temporary interruptions resulting from maintenance, failures or circumstances beyond its control.
  2. The Service Provider takes care to keep published content accurate and current. Technical information on the Website is general in nature and does not replace an individual analysis or design prepared for a specific facility.
  3. The above provisions do not limit the Service Provider's liability to the extent that mandatory provisions of law do not allow such limitation, in particular towards consumers.

§ 11. Final provisions

  1. Matters not governed by these Terms are subject to Polish law.
  2. The Service Provider may amend these Terms for important reasons, in particular changes in law or in the scope of services provided. Amended Terms are published on the Website together with the date of the update and apply from the date of publication.
  3. A consumer may use out-of-court complaint and redress procedures, including the online dispute resolution platform available atec.europa.eu/consumers/odr. Use of these procedures is voluntary.
  4. These Terms apply from 4 August 2026. This is an informative translation of the Polish original. In the event of any discrepancy, the Polish version prevails.
